Sarkhan Vol's ability

Ok... I ran into this problem in a game.

My opponent tried to use Sarkhan Vol's +1 ability which reads:

Creatures you control get +1/+1 and haste until the end of turn.

Good idea, but the only problem is: This guy had no creatures in play to get the bonus.

So I guess my question is: Can one legally use said ability in this situation?

The cost is changing the number of loyalty counters, and this ability doesn't require you to do anything else. Can he pay the cost?

yup, and the ability doesn't target so not having valid targets isn't an issue

You can always use effects or spells in targets that are not affected by it, just to have a benefit somewhere else, like the loyalty counters.
