Nephilim were the original 4 color commanders for a long time before Commander 2016 was released (10+ years), since a limited amount of commanders (none originally) were available to play those colors. It was a casual decision originally enforced by the old guard of those who loved EDH. You can research the forums way back if you'd like on their inclusion.But technically, you are correct, they are not legendary. Depends if you're the 5% playing competitive 1v1 EDH or something more kitchen table focused.
Wild Slash would be the major consideration for me if DNT and TNN get an uptick in the meta. Arc trail at the time was likely a concession to 4C Control (hitting DRS and Strix with trail was very decent).
